I am writing on behalf of my husband a formal complaint against Seth Hancock regarding his/her conduct as my attorney. The details of the complaint are outlined below:
1. Failure to Provide a Contract:
Despite paying a retainer fee of $5000 to Seth Hancock he failed to provide a written contract as required by California law. This lack of a contract has left me in a disadvantageous position and has made it difficult for me to determine the terms and conditions of our attorney-client relationship.
2. Refusal to File Removal Enhancements and Violation of Legal Obligations:
Seth Hancock failed to fulfill his/her professional obligations by refusing to file a motion to remove enhancements as per California Penal Code sections 667, 667.5, and 122022. These enhancements are crucial to my case, and their omission has severely affected my legal representation.
3. Failure to Maintain Communication:
Despite multiple attempts to contact Seth Hancock , he/she consistently ignored my calls and failed to respond to my inquiries. This lack of communication has hindered my ability to stay informed about the progress of my case and has left me feeling neglected and abandoned.
4. Breach of Contract:
Although Seth Hancock failed to provide a written contract, we entered into a verbal agreement that he/she would complete a brief by a specific deadline, which was agreed to be two weeks ago. However, [Attorney’s Name] has failed to fulfill this obligation, displaying a disregard for professional ethics and causing additional harm to my case.
5. Disrespectful Behavior:
During our interactions, Seth Hancock demonstrated disrespectful behavior by refusing to allow me to see the brief he/she was supposed to complete. This behavior is unprofessional and undermines the trust and confidence I should have in my attorney.
