Judge:

Hon. Jaquelyn H. Duffy

San Luis Obispo
California

My name is James Hydrick. Judge Jaquelyn H. Duffy ran my first civil trial in 1988 under California’s SVP act. She allowed the prosecution to get away with a Brady violation. The jury ruled 10 – 2 in my favor that I did not meet the criteria for the SVP law. Judge Duffy appeared visibly shocked at the ruling.

A second trial was held in 2014 with Judge Duffy presiding. The evidence from the first trial was NOT allowed to be used. The alleged victims’ statements changed from what they testified at the first trial. One particular alleged victim claimed that his original statement was fabricated. The DA’s investigator, Michael Hoier, told the alleged victim that if he testified the same as he had in the first trial, Detective Hoier would get this alleged victim moved to a facility closer to his family (as the alleged victim was himself incarcerated at this time.)  So in the 2nd trial, this alleged victim lied again.

Judge Duffy also allowed two people who never alleged any wrongdoing, never claimed they were victims, nothing — to take the stand and testify as victims. On top of this, Judge Duffy barred my expert witnesses.

It took 17 years to get me to trial. I wrote to Judge Duffy many times that my right to a fair and speedy trial was violated, due process was violated, and my communication was ignored.
