On March 12,2014 Charles Brown was a passenger in a car that was pulled over in Racine Wisconsin for allegedly license plate infractions which no traffic citation was given for it. Deputy Kevin Kazmierski immediately called for a K9 based on the color of our skin and ordered (not asked) us out of the car.
MISCONDUCT under Wisconsin § 946.12 (1-4): occurred when Deputy Kevin Kazmierski removed the front plate out of the windshield,then placed on the rear seat and then took photo in effort to justify probable cause to stop vehicle violating due process by using fabricated evidence. MISCONDUCT under Wisconsin § 946.12 (1-4): Deputy Kazmierski and Deputy Swartz unzipped my pants and went in my underwear touching my private parts with no search gloves on, while on the side of the highway. This was not a legal search because if they were concerned about their safety,me and the driver would have been searched immediately upon exiting the car,not 25 minutes later after allowing us to stand freely in front of the squad car watching them search our car. Criminal complaint contains false information that was hidden from the Courts.
PROSECUTOR UNETHICAL CONDUCT: Racine County District Attorney Richard Chiapete in 2014 was driving drunk, ran over city property and left the scene while prosecuting Brown’s case. Should have recused himself.
JUDGE MICHAEL PIONTEK Display of biasness on bench: Judge Piontek made unethical and disturbing comments on the bench during Brown’s sentencing on December 12, 2014 stating ‘Brown’s children are pretty lucky he wasn’t around because they turned out well’.
JUDGE MICHAEL PIONTEK violated Due Process; after granting a new hearing, refused to allow Deputies to be cross examined at 2nd Machner Hearing. Attorney Dustin Haskell did not subpoena Deputies to 1st hearing- ineffective assistance of counsel. Without cross examination, virtually impossible to prove trial attorney ineffective for not filing a motion to suppress.
Judge MICHAEL PIONTEK was disciplined for conducting independent investigation into criminal defendants in the year of 2014,same timeframe Brown took his plea. Judge PIONTEK was represented by Patrick CAFFERTY for Judicial hearings.
Charles Brown’s § 974.06 with judicial complaints and return of property was denied by Judge Kristen M. CAFFERTY who mysteriously took over Judge PIONTEK courtroom. Questions the Integrity of judicial system in Racine Wisconsin.
