RACINE COUNTY WISCONSIN TWO TIER SYSTEM OF JUSTICE!! Wisconsin Court System identified significant racial disparities in the likelihood that a black man felony conviction will result in a prison sentence (Rather than probation or program); Study concluded that white men were 21% less likely than similarly situated me of color to receive a prison sentence. Black men were 28% more likely than similarly situated white men to receive a prison sentence. These findings alone are grounds for a sentence adjustment (25% reduction of time in prison) ‘In The Interest of Justice’ for a person of color who received a disproportionate prison sentence. How much Official Misconduct is allowed in a criminal case?
Misconduct in Public Office under Wis. Stat. § 946.12 (1,2,3,4) by Deputy Kevin Kazmierski and Deputy Dale Swart, where at the time of the stop I was Guilty of riding in a car while Black; car had air freshener in the ash tray which is legal (not weed, cigarette or any drug smell). Only smell that day was we was Black! driver gave Kazmierski a valid driver’s license and based on our race and past records order us ( no consent sought) out the vehicle whereas probable cause was fabricated by removing visible front plate out the windshield (front plate bracket broken)(photos off Racine disc verify this), at most these are traffic violations even though it’s fabricated which no citation was given, a warning issued 3 hours later. There was not a safety issue (Terry/Long) as We were not frisked upon exiting vehicle and allowed to stand freely in front of squad car while Deputies search vehicle. 25+ minutes later Deputy Kazmierski states he wanna search me for a weapon, as he do his blade his finger pushes my anus forcing me to jump, then he unzipped and entered my pants (no search gloves on) touching my private parts and again reaching between my buttocks, this ain’t a search more of sexualized patdown.
District Attorney Richard Chiapete Misconduct in Public Office under Wis. Stat. § 946.12 (1,2,3,4) / Wis. SCR 20:8.4(c) §19.45(5) no state public official may use or attempt to use public position to influence or gain unlawful benefits D.A. Chiapete was driving drunk, had an accident and left this scene during the prosecution of my case (2014). D.A. should have recused himself once he participated in a Criminal Act. D.A. must have ethical conduct at all times and he has a duty to seek Justice not to simply obtain convictions. Now relevant documents are turned over from prosecution that Brown’s Criminal Complaint knowingly contains false information concerning driver, A GPS monitoring report obtained from Justice point in Milwaukee and a proffer agreement with the name blacked out,ultimately agreeing Brown’s Due Process was violated.
JUDGE MICHAEL PIONTEK Misconduct in Public Office is disturbing considering he is hired by taxpayer’s to Judge honestly and fairly but demonstrated the Law don’t apply to him. PIONTEK was convicted of DNR wildlife-related charges in Ashland County (Wisconsin Outdoor News/May 15, 2020) where also marijuana was found in cabin and property owned by Judge Michael Piontek,how ethical is this for a man who judges so biasedly? Above the Law. The same Judge who passed judgement on me stating’ My Kids are lucky I wasn’t around’. This same Judge who refused to let Deputies responsible for the TERRY STOP be cross examined at the evidentiary hearing, then boldly Commented; ‘ Whether it has merits or doesn’t have merits today,yesterday, at the time of the incident, whether the law changed or didn’t, none of that matters’.Incredible.
JUDGE MICHAEL PIONTEK was convicted by Wisconsin Judicial Commission May 21, 2019, 386 wis .2d 703, 2019 WI 51 927 N.W. 2d 552)where he openly admitted to doing independent investigation into cases(2014) during the time-frame Brown duped into a promised plea of 7 years in, whiçh PIONTEK tripled to 20 years in and 10 years out.

Cafferty now holds Michael PIONTEK old courtroom refusing to acknowledge PIONTEK abuse and wrongdoings an the bench. More Judicial retaliation expected but the truth need to be told. A violation of my Constitutional rights virtually jumps off the record in this case.
